BOARD OF SELECTMEN
Minutes
May 29, 1996
Board met in Regular Session 7:30 p.m. in their Meeting Room in Abbot Hall
Present (constituting a quorum):

Motion made and seconded to approve the minutes of May 15, 1996 and May
22, 1996.
GRANT. PWED. Motion made to establish a PWED Project Oversight Committee
to advise the Downtown Streetscape Improvements Project. A six member Committee
shall be comprised of a representative from each of the following:
Board of Selectmen
Finance Committee
Chamber of Commerce
Old and Historic District Commission
Old Marblehead Improvement Association
Town Planner
The Committee's responsibilities will be to participate in the selection
process to hire a design/engineenng team; to review and select the design
details and elements of the project; and provide input into the scope of
work.
Motion made and seconded to appoint Chairman McNulty as the Selectmen's
Representative to the PWED Project Oversight Committee. All in favor.
Permission. Parade. It was the consensus of the Board to leave the vote
of May 8, 1996 pertaining to the annual Horribles Parade to remain as is;
i.e. the rain date will be Saturday, July 6.
FORT BEACH. Motion made and seconded to renew the leases for the fishermen
shanties at the Fort Beach turnaround until May 1997 as follows: Shanty
No. 1 - Todd Lausier;
Shanty No. 2 - Steven Bird; Shanty No. 3 - Peter Berry; Shanty No. 4 - John
W. Burns; Shanty No. 5 - William H. Powers; Shanty No. 6 - Perry Asher;
Shanty No. 7 - Daniel W. Roads, Jr.; Shanty No. 8 - William D. Brown,III;
Shanty No. 9 - John Hayes.
HIGHWAY DEPARTMENT. Transfer Request. Motion made and seconded to approve
the request of the Surveyor of Highways to appear before the Finance Committee
to request a transfer of $4,750 for hottopping area at new salt shed. All
in favor.
PERMISSION. Motion made and seconded to approve the request of Bruce
Cohen to block off the section of Leicester Road from Humphrey Street to
Brook Road for a block party on Saturday, June 15, 1996 from 12:00 to 5:00
p.m. subject to Police Department approval. The selectmen requested Mr.
Cohen to make all the neighbors aware of this. All in favor.
VENDORS. Rose McCarthy appeared before the Board to discuss an ice cream
truck being allowed inside Waterside Cemetery during the Memorial Day services.
The members of the Board pointed out the Town By-Law prevents vendors from
appearing on Town property.
Selectman Cutting left the meeting at this time stating a possible conflict.
LICENSE. All Alcoholic Beverage. Rosalie's Restaurant. (This portion of
the meeting is on audio cassette. ) Attorney Lawrence Plavnick appeared
representing Rosalie's Restaurant with an update on the process of the sale
of this restaurant. Motion made and seconded to continue this hearing to
July 10, 1996 at 8:00 p.m. Selectmen Conly stated that at that time he will
ask for consideration of revocation of the license.
One-day Liquor License. Motion made and seconded to approve the request
of the Jewish Community Center of the North Shore to have a one-day liquor
license on Sunday, June 2, 1996 from 11 a.m. to 4 p.m. All in favor.
PERMISSION. Road Race. Motion made and seconded to approve the request
of Patricia Rockett of Village Liquors to hold the Second Annual 5-Mile
Scholarship Road Race on Sunday, September 29, 1996 subject to Police Department
approval. The race will begin at Village Plaza at 1:00 p.m. and proceed
around the Neck, ending back at Village Plaza. All in favor.
Marblehead Power Squadron. Motion made and seconded to approve the request
of Mark Moore of the Marblehead Power Squadron to use State Street landing
to present an educational display in conjunction with National Safe Boating
Week on Saturday, June 1, with a rain date of Saturday, June 8, between
9:00 a.m. and 4:00 p.m. All in favor.
Motion made and seconded to recess at 8:11 p.m. All in favor.
Motion made and seconded to resume in open session at 8:30 p.m. All in favor.
LICENSE. All Alcoholic Beverage. Sail Loft. (This portion of the meeting
is on audio cassette.) Lieutenant Carney and Officer Decker represented
the Marblehead Police Department on this hearing on the All Alcoholic Beverage
License of the Sail Loft. Attorney Richard Plouffe of Wellesley, Massachusetts
appeared before the Board representing the Sail Loft. Motion made and seconded
that the Board finds the Sail Loft served an intoxicated person an alcoholic
beverage on March 17,1996. All in favor. Motion made and seconded that the
Board impose a suspension on the liquor license for Thursday, September
12,1996 and Friday, September 13, 1996. All in favor.
Motion made and seconded to adjourn at 9:15 p.m.
