BOARD OF SELECTMEN
Minutes
December 4, 1996

Board met in Regular Session 7.30 p.m. in their Meeting Room in Abbot Hall

Present (constituting a quorum):

Motion made and seconded to appoint Selectman Conly Chairman pro tem.


CHRISTMAS WALK. Scott Campbell appeared before the Selectmen seeking permission to fire his musket once every hour from 10 a.m. to 4 p.m. on Saturday, December 7, 1996 during the Annual Christmas Walk. Mr. Campbell is a Civil War re-enactor. Motion made and seconded to allow Scott Campbell, representing Marblehead Civil War soldiers, to fire his musket on December 7, 1996 subject to Police Department approval. All in favor.

Mr. Mc Nulty joined the meeting at 7:35 p.m. and took over as Chairman.

MINUTES. Motion made and seconded to approve the minutes of the meeting held November 26, 1996.

TOWN ENGINEER. Douglas Saal. Mr. Saal appeared before the Board with several updates. House numbering in conjunction with the E-911 system has been completed and any new house numbering will be sent out with the tax bills at the end of December. Colonial Court and Prospect Court are eliminated as addresses as these are not streets that have been approved by the Selectmen. Colonial Court will have a Jersey Street address and Prospect Court will have a Prospect Street address. No other streets have been eliminated. A discussion was held concerning the drainage basin at the new Park and Rec/COA building. Mr. Saal said this hole could be covered over if a tank were put in place. The Selectmen asked Mr. Saal to come forth with some options and costs.

FRIENDS OF TIM ANGLE CONCERT. Justin Osborne gave the Selectmen an update on the upcoming concert for the benefit of Tim Angle and his family. The concert is December 19 and 20, 8 p.m. in Abbot Hall. AII proceeds will go to the Angle family. Motion made and seconded to allow the Friends of Tim Angle to sell tickets on public property for this event. All in favor

CHAMBER OF COMMERCE CHRISTMAS WALK. Motion made and seconded to allow the Chamber of Commerce and the Festival of Arts to use the sidewalk and part of the street for staging from 1 p.m. until the close of the event and the staging is removed on December 6, 1996. All in favor.

BOARD OF ASSESSORS. Richard L. Phelan, Chairman of the Board of Assessors, and Michael Johnson, Assistant Assessor, presented their Classification Tax Allocation Memo for FY '97. Motion made and seconded to approve a 100% Residential Factor. All in favor. Motion made and seconded to grant no discount to Open Space. All in favor. Motion made and seconded not to adopt a residential exemption. All in favor. Motion made and seconded not to adopt a small commercial exemption. All in favor.

LICENSE. Common Victualler. TCBY of Marblehead. Stefan Manzo and Milorad Grubor appeared before the Selectmen requesting a Common Victualler License to operate TCBY of Marblehead, a retail food store, at 27A Atlantic Avenue. Hours of operation will be Monday - Thursday, noon to 9 p.m., Friday and Saturday, noon to 10 p.m.; and Sunday, noon to 9 p.m. Motion made and seconded to approve the request. On a polled vote, the Board voted as follows: Mr. Cutting, in favor; Mr. Purdin, in favor; Mr. Conly, in favor; Mr. McNulty in favor.

All Alcoholic Beverage. Sand Bar and Grille. Christopher Corbishley appeared before the Board to request an amendment to the All Alcoholic Beverage License as a Common Victualler for the Sand Bar and Grille. The amendment is a change in the description of the Licensed Premises. New description as follows: Wooden building, two stores, pub seating 52, lounge seating 38, dining room seating 64, function room seating 42, liquor storage on the second floor and in the basement. Motion made and seconded to approve the request. On a polled vote, the Board voted as follows: Mr. Cutting, in favor; Mr. Purdin. in favor; Mr. Conly. in favor, and Mr. McNulty, in favor.

TRAFFIC & SAFETY. South and Middle Streets. Letter read from Police Chief Palmer reporting on speeding on Middle and South Streets. Three shifts checked for speeding on these streets beginning Thursday, November 14, 1996 and ending Sunday, December 1, 1996. Six motor vehicles were given citations on Middle Street, and no speeding violations were reported on South Street.

NORTH SHORE REGIONAL VOCATIONAL SCHOOL. Motion made and seconded to refer a letter from Michael Wood, Town Administrator for the Town of Nahant, as it relates to the North Shore Regional Vocational School and the Fiscal 1997 assessment process to Marblehead's representative to the School, Carolyn Stanton. The Board would like Mrs. Stanton to review the letter and report back to them. All in favor.

SCHOOL DEPARTMENT. Motion made and seconded to have Town Administrator Sasso confer with the Superintendent of Schools to see if the Town would be interested in supporting the Massachusetts League of Women Voters proposal to challenge the way State Education Aid (Chapter-70) is allocated among Massachusetts cities and towns. All in favor. The Town of Sandwich is having a joint meeting of the Chair of the Milton Finance Committee, Sandwich Selectmen, Finance Committee and School Committee and members of their State House Delegation on December 5, 1996 to discuss the proposal.

DRAINS. Motion made and seconded to refer to the Town Engineer, Surveyor of Highways and the Water and Sewer Department the letter from Margaret Farrell, Chairman of the Shipyard Association, as it relates to street and yard flooding in the low section of the Shipyard neighborhood. The Selectmen would like these departments to report back to the Board. All in tavor.

PERMISSION. Motion made and seconded to approve the request of the Recreation, Parks, and Forestry Department to approve the National Multiple Sclerosis Society's request to hold a walkathon on April 12, 1997 to raise funds for M. S. subject to Police Department approval. This walk is known as the Marblehead Sea Stroll. All in favor.

LICENSE. One-day Entertainment. Motion made and seconded to approve the reguest of Flynnies on the Avenue to have a one-day entertainment license for their staff Christmas party on Tuesday, December 17, 1996 from 6:30 p.m. - 11:30 p.m. The entertainment will be a deejay. All in favor.

One-day All Alcoholic Beverage. Motion made and seconded to approve the request of the Dolphin Yacht Club to have a one-day All Alcoholic Beverage License for December 8, 19'96 trom 4:00 p.m to 11:55 p.m. All in favor. In the future, the Board would like at least a two-week notice for such a request.

ANNUAL TOWN MEETING. Motion made and seconded that the Annual Town Meeting be held on Monday, May 5 1997 at 7:45 o'clock in the afternoon. All in favor. Motion made and seconded to Open the Warrant for the May 5, 1997, Annual Town Meeting. All in favor. Motion made and seconded to close the Warrant for Town Government Boards and Commissions on Wednesday, January 29,1997 at 5 p.m. All in favor. Motion made and seconded to close the Warrant for the general public on Wednesday, February 5, 1996 at 5 p.m All in favor.

SELECTMEN'S ADVISORY COMMITTEE ON DISABILITIES. Motion made and seconded to appoint Lloyd Caswell as technical advisor to this committee. All in favor.

LlCENSES. Alcoholic. Motion made and seconded to allow restaurants to serve alcohol on New Years Eve until 1 a.m. January 1, 1997. All in favor.

Motion made to hold a public hearing for cancellation or nonrenewal of Rosalie's All Alcoholic/Seven Day with Common Victualler License. No second. Motion made and seconded to approve Rosalie's All Alcoholic/Seven Day with Common Victualler License. Three selectmen voted in favor, Mr. Conly, opposed.

TUCKER'S WHARF. Motion made and seconded to reject all bids for the seawall at Tucker's Wharf. Three Selectmen voted in favor, Mr. Conly voted present Motion made and seconded to re-advertise the contract in accordance with the schedule put before the Selectmen by Town Planner Rebecca Curran. Three selectmen voted in favor; Mr. Conly voted present.

TOWN ADMINISTRATOR. Chairman McNulty acknowledged the second anniversary of Mr. Sasso being Town Administrator for the Town of Marblehead. Compliments for a job well done were extended by all Board members.

Chairman McNulty acknowledge the recent death of Robert Triplett, the founder of the Marblehead Reporter. Sympathy was extended to his family.
