BOARD OF SELECTMEN
Minutes
December 27, 1995
Board met in Regular Session 7:30 p.m. in their Meeting Room in
Abbot Hall
Present (constituting a quorum):
William M. Purdin, Chairman Pro Tem

Anthony M. Sasso, Town Adminstrator
Mr. Peck made a motion that William M. Purdin be Chairman pro
tem. Seconded. All in favor.
LICENSES. Letter from Police Chief Palmer had been sent to members
of the Board relative to an alleged incident at Lobster Lover's
Restaurant. Motion made and seconded to refer this letter to Town
Counsel. All in favor.
CONSERVATION COMMISSION. Letter read from Jack Attridge on behalf
of the Goldthwait Reservation Association outlining their pursuit
of a solution to the pharamites problem associated with the salt
marsh. This is in response to the letters from the Glover School
fourth graders which the selectmen read at their meeting on December
13, 1995.
Rosalie's Restaurant
LICENSE. All Alcoholic. Rosalie's Restaurant. Letter addressed
to Rosalie. Harrington notifying her of this Non-renewal/Cancellation
Hearing was read into the record. Attorneys Jeffrey Loeb, represented
Ms. Harrington, Attorney John Doonan represented George Harrington,
the prospective buyer of the restaurant, and Attorney Larry Plavnick
represented Rosalie's Restaurant as the debtor in Bankruptcy Court
appeared before the Board. It is expected a purchase agreement
will be executed within ten days. Ed Niemeyer and Suzanne Niemeyer
of 17 Sewall Street spoke in opposition to this license. After
a discussion among the Board members, motion was made and seconded
to renew the All Alcoholic Beverages License for 1996 of Rosalie's
Restaurant. All in favor. Motion made and seconded to continue
the hearing as regards cancellation of the license under chapter
138, section 77 because the licensee has ceased to conduct the
licensed business until February 28, 1996. All in favor.
Lazybones Restaurant
LICENSE. All Alcoholic. Mast, Inc. d/b/a Lazybones. Letter addressed
to Christopher Corbishley, President of Lazybones Restaurant,
notifying him of this Non-renewal/Cancellation Hearing was read
into the record. Attorney John Whipple, representing Mr. Corbishley,
and Mr. Christopher Corbishley appeared before the Board. A closing
of the sale of this restaurant to Jeff Flynn of Flynnie's, Inc.
is scheduled for March 1, 1996. No one spoke in opposition. After
a discussion among the Board members, motion was made and seconded
to renew the All Alcoholic Beverages License for 1996 for Mast,
Inc. d/b/a Lazybones. All in favor. Motion made and seconded to
continue the hearing as regards cancellation of the license under
chapter 138, section 77 because the licensee has ceased to conduct
the licensed business until January 17, 1995. All in favor. Motion
made to ask Assistant Town Counsel to report back to the Board
at the next meeting with regard to the legality of transferring
a liquor license prior to sale. All in favor.
LICENSES. Alcoholic. Motion made and seconded to approve traditional
one-hour extension to 1:00 a.m. for New Year's Eve for holders
of Alcoholic Beverage Licenses. All in favor.
LICENSES. Common Victualler. Motion made and seconded to approve
the change of name of Mr. Smoothie's to the Kitchen Witch Eatery.
All in favor.
