BOARD OF SELECTMEN
Minutes
November 6, 1996
Board met in Regular Session 7.30 p.m. in their Meeting Room in Abbot Hall
Present (constituting a quorum):

SPIRIT OF '76. The Board of Selectmen acknowledged a gift of a reproduction
of The Spirit of '76 done in marquetry from Grace Barrickman of Cinnaminson,
New Jersey, done by William Bader. Mr. McNulty thanked her for her generous
donation which will become part of the Town's archives and will be hung
in Abbot Hall in the future.
SPECIAL TOWN MEETING. Finance Committee. There will be a Special Town
Meeting Warrant hearing, Thursday, November 7, 1996, in the Selectmen's
Meeting Room, Abbot Hall, 7:30 p.m. The public is invited.
SEXUAL HARASSMENT POLICY. Motion made and seconded to approve the amended
version of the Sexual Harassment Policy that is consistent with State statute
as outlined in the document presented by Town Administrator Sasso. All in
favor.
LICENSE. One-day Wine and Malt. Motion made and seconded to approve
the request of the Dolphin Yacht Club for a one-day Wine and Malt License
for Friday, November 8,1996 from 6:00 p.m. to 11:00 p.m. All in favor.
ROAD RACE. Motion made and seconded to approve the request of Phoenix
Fitness of Marblehead to hold their Fifth Annual Phoenix Fitness Run for
Your Life road race and walk on Sunday, May 25, 1997 at 1:00 p m., subject
to Police Department approval. All in favor.
WORLD AIDS DAY. Dr. Lewis Hays appeared before the Board to bring them
up to date on World Aids Day. Marblehead's Aids Awareness Committee is presenting
a concert, free to the public, on World Aids Day which is Sunday, December
11, 1996, in Abbot Hall. Proceeds will go to Boston Pediatrics.
MARBLEHEAD POLICE ASSOCIATION. Mr. McNulty read from a press release
of this association which announced a free concert on Saturday, November
9, at the Aldrich Center tor the Performing Arts, Marblehead High School
from 6:30 p.m. until 10:30 p.m. Doors will open at 6:00 p.m. The Marblehead
Police Association is using this concert for the purpose of raising funds
to assist Tim Angle and his family. Tim, a 1996 graduate of Marblehead High
School is currently a freshman attending the University of Wisconsin. He
is critically ill with bacterial meningitis The funds raised will help defray
medical and other expenses for Tim and his family. The Board went on record
acknowledging the work of the Marblehead Police Association for their work
on this worthy project.
LICENSE. One-day Entertainment. Motion made and seconded to approve
the request of Gordon Howard, Manager of the Rio Grande Cafe, for two one-day
entertainment licenses, one for Wednesday, November 27, 1996, and one for
Tuesday, December 31, 1996. This would be for low amplified live music.
All in favor.
POLICE DEPARTMENT. Motion made and seconded to approve the request of
Police Chief Palmer to accept the refusal of Cabot Dodge as a full-time
police officer and request the Department of Personnel Administration place
his name back on the permanent intermittent list for consideration for a
full-time appointment at a later date. All in favor.
FIRE DEPARTMENT. Chief Charles Maurais appeared before the Board to
discuss contracts. Motion made and seconded to award the contract for a
1500 GPM Heavy Duty Emergency Type Fire Apparatus to the lowest responsible,
responsive bidder, Seagrave Fire Apparatus Inc. of Clintonville, Wisconsin,
for $225,500.00 contingent upon the execution of a satisfactory contract
and submission of the required bond, insurance and other documents. All
in favor. Motion made and seconded to award the contract for a Heavy Duty
Custom built 75 Foot Aerial "Quint" to the lowest responsible
responsive bidder, Kovatch Mobile Equipment Corp. (KME) of Pennsylvania,
for $443,152.00 contingent upon execution of a satisfactory contract and
submission of the required bond, insurance and other documents. All in favor.
MINUTES. Motion made and seconded to approve the minutes of October
30, 1996. All in favor.
TRAFFIC & SAFETY. Motion made and seconded to make permanent the
parking restrictions approved on a 30-day trial basis at the meeting of
October 2, 1996. All in favor. The Selectmen will meet at the Oko's on Sunday,
November 10, at noon for a site review prior to next week's public hearing
as it relates to making South and Middle Streets one way.
NORTH SHORE AMBULANCE. Contract. Selectman St. Laurent announced an
modiilcation to the Town's contract with North Shore Ambulance whereby no
furtller compensation shall be paid by the Town to North Shore Ambulance
from November 1, 1996 thlrough June 30, 1999. This amounts to a savings
of $119,766.90 to the Town . Motion made and seconded to accept the modification
of this contract. All in favor
PLANNING BOARD. MARBLEHEAD HOUSING AUTHORITY. Mr McNulty reminded the
citizens of Marblehead that there are openings on these two Boards. Interviews
will be held on December 4th. All interested applicants should contact the
Selectmen's Office.
U.S.S. CONSTITUTION. Mr. Conly nominated Mr. Cutting to be a Committee
of One to meet with Commander David Cashman and Dr. Ray Cole, and work with
Mr. Sasso and Mr. McNulty, as it relates to having the U. S. S. Constitution
visit Marblehead Harbor in 1997. All in favor
COA/REC & PARK BUILDING. The Selectmen discussed the excessive length
of the closing of Humphrey Street for placement of drainage. They requested
Mr. Sasso to see if he could get this resolved.
Motion made and seconded that the Board go into Executive Session to
consider a matter of pending litigation, votes may be taken, and if they
are, votes will be released at at a time deemed appropriate by counsel,
not to resume in open session. On a polled vote, the Board voted as follows:
Mr. Cutting, in favor; Mrs. St. Laurent, in favor, Mr. Conly, in favor;
and Mr. McNulty, in favor.
