BOARD OF SELECTMEN
Minutes
November 26, 1996

Board met in Regular Session 7.30 p.m. in their Meeting Room in Abbot Hall

Present (constituting a quorum):

Motion made and seconded to approve the minutes of November 20, 1996 All in favor.

FRIENDS OF TIM ANGLE CONCERT. Justin Osborne appeared before the Board with an update on the Friends of Tim Angle Concert which is scheduled for Abbot Hall on December 19 and 20. Tickets are available at 639-4486 or through the Selectmen's Office (631-0000) for a donation of $10.00.

CHIEF PROCUREMENT OFFICER. Rebecca Curran, the Town's Chief Procurement Officer, appeared before the Board to explain the process for disposing of vacant buildings and land owned by the Town. Currently, the Legion Building and Ten School Street are buildings that are candidates for this process. Anything valued over $500 follows the 30B process for real estate disposition. The Board must vote to declare the real estate surplus. Then any re-use restrictions are set through public hearings, comments and solicitations. The value of the property is determined through appraisal or assessment. Chapter 40, Section 15 requires the proposal go to Town Meeting prior to developing the RFP. Then the RFP is developed and put out to bid.

HARBORS AND WATERS BOARD. The Chairman ofthe Harbors and Waters Board, Paul Williams, appeared before the Board with an update on the seawall at Tucker's Wharf Their Board had voted on November 21, 1996 to recommend to the Selectmen the placement of a purchase order with North Shore Marine on the basis that they are the least cost acceptable bidder and is recommended by our consultant, Bourne Consulting Engineering. Price for the contract includes our base scope and the alternates to the extent possible up to and not to exceed the price of $425,000. Assistant Town Counsel Walsh-Rogalski reminded the Board that the Statute requires that the contract be awarded to the lowest responsible and eligible bidder which is defined as the bidder which is the lowest of those possessing the skill, ability and integrity to do the performance of the work. Motion made and seconded to take this under advisement for one week and vote next week. All in favor.

U.S.S. GLOVER. Motion made and seconded to ask Dr. Ray Cole to investigate the information as put forth in a letter from D. H. Taylor as it relates to the possibility of having a Burke class ship named for General Glover, and report back to the Board. All in favor.

TOWN PLANNER. Selectman Conly asked Town Planner Rebecca Curran to investigate to see if the name of Colonial Court has been changed to No. 7 Jersey Street, and Prospect Court renamed 15 Prospect Street, and to check the numbering of 441 Atlantic Avenue off Carlton Road

MARBLEHEAD HIGH SCHOOL. Football Team. Motion made and seconded to send a letter to the Marblehead High School Football team encouraging them to put their best efforts forward and good luck in the game against Swampscott on Thanksgiving. They can do it this year! All in favor.

BY-LAW. Chairman McNulty reported the Town of Lee, Massachusetts has a set of regulations pertaining to the placement of newspaper boxes. Mr. McNulty suggested the Board review this and consider the placement of this on the Annual Town Meeting Warrant.

The members of the Board extended best wishes for a Happy Thanksgiving to all the citizens of Marblehead.

Motion made and seconded that the Board go into Executive Session to consider discipline of an employee and to discuss strategy with respect to collective bargaining, votes may be taken, and if they are, votes will be released at a time deemed appropriate by counsel, not to resume in open session. On a polled vote, the Board voted as follows: Mr. Cutting, in favor; Mr. Purdin, in favor; Mr Conly, in favor; and Mr. McNulty, in favor.
