Board met in Regular Session 7.30 p.m. in their Meeting Room in Abbot Hall
Present (constituting a quorum):

Town Clerk, Betty J. Brown, appeared to swear in the newly elected Board.
Motion made and seconded to reappoint Thomas A. McNulty Chairman for the
ensuing year. All in favor.
FINANCE DEPARTMENT. Revenue Officer. Motion made and seconded to accept
the bid of Baybank NA at the rate of 4.75 to borrow $1,375,000 for a Bond
Anticipation note from May 23, 1997 to June 30, 1997. All in favor
MINUTES. Motion made and seconded to approve minutes of May 7, 1997. All
in favor.
U.S.S. CONSTITUTION. Chairman McNulty announced the Navy is looking at the
possible option of the U.S.S. Constitution paying a two-day visit to Marblehead.
She would be brought into the Harbor and mooreed there both Sunday and Monday,
July 20 and 21. Overnight accommodations for 150 crew members would be needed
with the citizens of the Town. Chairman McNulty stressed that this option
is only being investigated.
Seelctman Conly mentioned the receipt of a gift to the Town by William Hamson
of papers belonging to his late father, William T. Hamson, Harbormaster
during the 1930's. Among the papers was a document showing the drawing coordinances
of the exact location and type of mooring for the U.S.S. Constitution when
she visited Marblehead in 1931.

SPECIAL ELECTION. Motion made and seconded that prior public notice of the
Board of Selectmen's intention to call a special town meeting for the purpose
of a special election for approval of an override and bond exclusion under
Proposition 2 l/2 be waived because in the opinion of the Board of Selectmen
the public interest would suffer from such a delay. All in favor.
Motion made and seconded that a special town meeting be called for June
9, 1997 for the purpose of a special election to vote on questions relative
to overrides and exclusions under Proposition 2 and l/2. All in favor.
Motion made and seconded that the warrant be opened for insertion of questions.
MOTION OF THE BOARD OF SELECTMEN, BY TWO-THIRlDS VOTE TO SEEK VOTER APPROVAL
AT A SPECIAL ELECTION TO ASSESS TAXES IN EXCESS OF THE AMOUNT ALLOWED PURSUANT
TO GENERAL LAWS CHAPTER 59, SECTION 21C FOR THE PAYMENT OF PRINCIPAL AND
INTEREST ON BONDS, NOTES OR CERTIFICATES OF INDEBTEDNESS.
Moved and seconded that the Board of Selectmen seek voter approval at a
special election to be held on June 9, 1997, to assess taxes in excess of
the amount allowed pursuant to General Laws Chapter 59, Section 21 C for
the payment of principal and interest on bonds, notes or certificates of
indebtedness, all as set forth in the following Question 1:
Question 1: Shall the town of Marblehead be allowed to exempt from the provisions
of
proposition two and one-half. so-called, the amounts required to pay for
the bond issued in order to fund Article 44 of the 1997 Annual Town Meeting
for purchasing land now or formerly of Guide, located on Pleasant Street
and improvement thereof including paving and landscaping for use by Abbot
Public Library, and for other municipal uses?

for the purpose of purchasing computers and support software and equipment
and necessary accessory furnishings for the use of the School Department?

AT A SPECIAL ELECTION TO ASSESS TAXES IN EXCESS OF THE AMOUNT ALLOWED PURSUANT
TO GENERAL LAWS CHAPTER 59, SECTION 21C FOR THE PAYMENT OF PRINCIPAL AND
INTEREST ON BONDS, NOTES OR CERTIFICATES OF INDEBTEDNESS.

for the purpose of remodeling, reconstructing and making extraordinary repairs,
including all professional architectural and engineering fees, to the Bell,
Lower Bell, Coffin, Gerry, Middle and High School, including playing fields?

MOTION OF THE BOARD OF SELECTMEN, BY TWO-THIRDS VOTE TO SEEK VOTER APPROVAL
AT A SPECIAL ELECTION TO ASSESS TAXES lN EXCESS OF THE AMOUNT ALLOWED PURSUANT
TO GENERAL LAWS CHAPTER 59, SECTION 21C FOR THE PAYMENT OF CAPITAL OUTLAY
EXPENDITURES.
Moved and seconded that the Board of Selectmen seek voter approval at a
special election to be held on June 9, 1997, to assess taxes in excess of
the amount allowed pursuant to General Laws Chapter 59, Section 21C for
the payment of capital outlay expenditures, all as set forth in the following
Question 4:
Question 4: Shall the town of Marblehead be allowed to assess an additional
$20,000.00 in real estate and personal property taxes for the purpose of
making capital improvements to the skateboard park for the fiscal year beginning
July first, nineteen hundred and ninety-seven?

Motion made and seconded that the warrant be closed for insertion of questions.

POLICE DEPARTMENT. Motion made and seconded to approve the request of Police
Chief John Palmer to indemnify Officer Roy Ballard for medical treatment
received while conducting physical fitness drills at the Police Recruit
Academy on October 25, 1996. All in favor.
BUILDING COMMISSIONER. Motion made and seconded to approve the request of
Alan Hezekiah, Building Commissioner, to appear before the Finance Committee
for the following requests for transfer from the reserve fund: $2,702.29
to be transferred to Public Buildings Expense to be used for Legion Building
Utility Bills; $50.08 to be transferred to Building Commissioner's Salaries
for overtime for nonexempt employee; $938.62 to be transferred to Public
Buildings Salaries to be used for custodial overtime; $6,850.00 to be transferred
to Building Commissioner's expenses to be used for the Traffic Light at
Tent's Corner. All in favor.
SELECTMEN'S DEPARTMENT. Motion made and seconded to approve the request
of the Selectmen's Department to appear before the Finance Committee to
request a transfer of $11,356.10 to be transferred to Selectmen's Expense
for Labor Attorney services and disbursements rendered. All in favor.
PARKING CLERK. Motion made and seconded to approve the request of the Parking
Clerk to appear before the Finance Committee to request a transfer of $2,775.00
to be used for payment of data processing of tickets. All in favor.
SCHOOL DEPARTMENT. Letter was read from Barbara Anderson and Bob Hamond
as it relates to their concern for code violations that the fire alarm systems
in our schools are defective and in need of repair and that there is a public
safety concern as mentioned by the Capital Planning Committee at last week's
Town Meeting. A letter in response to their concerns was read from Fire
Chief Maurais. Motion made and seconded to appoint Selectman St. Laurent
as a Committee of One to investigate this further and report back to the
Board as soon as possible. All in favor.
ABBOT HALL. Motion made and seconded to approve the request of Linda Hodgkinson,
Executive Director of the Chamber of Commerce, to use Abbot Hall Auditorium
on Tuesday, May 20, 1997 at 7 p.m. All in favor.
TRAFFIC & SAFETY. Motion made and seconded to refer the letter received
from Christine and Marc Beringer as it relates to a potentially dangerous
traffic situation at the end of Lee Street connecting to Hooper and Union
Streets to the Traffic & Safety Committee. All in favor.
CAPITAL PLANNING COMMITTEE. Letter of resignation by Jay Michaud, member
of the Capital Planning Committee, was read. His resignation was accepted
with regret and appreciation was extended for his twenty-one years of service
to the Town, first on the Finance Committee and more recently as a member
of the Capital Planning Committee.
PERMISSION. Homestead Road. Motion made and seconded to approve the request
of Pamela Burch to grant permission to the residents of Homestead Road to
block of their street for a block party on Sunday. May 25, 1997 from 3 to
7 p.m., with a rain date of May 26, 1997 subject to Police Department approval.
All in favor.
Weston Road. Motion made and seconded to approve the request of Diane B.
Barbour to grant permission to the resident of Weston Road to block off
their street for a block party on Sunday, May 25, 1997 from 3 to 9 p.m.
subject to Police Department approval. All in favor.
Parade. Motion made and seconded to approve the request of the Gerry #5
V.F.A., Inc. to hold the Annual Horribles Parade at 10 a.m. on Friday, July
4 with a rain date of Saturday, July 5. The parade route will remain the
same as in previous years. All in favor.
Motion made and seconded to grant approval for Mr. Sasso to work in concert
with Recreation and Park Department in approving the request of Elle Sullivan,
Producer of Froomer Pictures, Ltd. to use the bluffrocks at Castle Rock
on Thursday, May 22,1997. All in favor.
GIFT. Chairman McNulty acknowledged receipt of a gift from Carol Cote of
Marblehead of a Civil War Pouch formerly owned by her great grandfather,
William Whitney of Richmond, Maine. Mr. Whitney was a member of the Maine
Regiment during the Civil War, having fought in Virginia.
GRANT. Motion made and seconded to authorize the Chairman to sign a grant
application for the Council On Aging for Senior Wellness and Fitness Programs.
All in favor.
PERMISSION. Motion made and seconded to approve the request of Partisan
Pictures of New York City to use The Spirit of '76 in a three-part series,
documentary and reenactment of major themes in American history from colonial
times to the Bicentennial in 1976, being produced for Readers' Digest, to
be distributed on North American television. All in favor.
Motion made and seconded to go into Executive Session to discuss strategy
with respect to pending litigation, votes may be taken, if they are, votes
will be released at a time deemed appropriate by Counsel, not to resume
in open session. On a polled vote, the Board voted as follows: Mr. Cutting,
in favor; Mr. Purdin, in favor; Mrs. St. Laurent, in favor; Mr. Conly, in
favor; and Mr. McNulty, in favor.
